What is Construction Law?

Construction law deals with legal issues that may arise during construction projects and the construction of structures. These issues are generally related to local regulations and related laws such as the Turkish Penal Code (TCK) and the Turkish Commercial Code (TTK). Therefore, legal provisions regarding construction law are very important.

TCK is one of the most important legal documents in construction law. The TCK determines the crimes and penalties that may arise during construction projects and construction of structures. Under the TPC, the most important provisions regarding construction law are safety-related crimes, environmental-related crimes and fraud-related crimes.

What Subjects Does Construction Law Cover?

Safety-related offenses relate to violating regulations regarding the safety of workers during construction. These offenses may include work-related accidents that result in worker injury or death. The TCK requires builders and contractors to comply with occupational safety regulations and ensure the safety of workers. Those who do not comply with these provisions may face serious penalties.

Environmental crimes cover activities that harm the environment during construction. For example, crimes such as violating waste and pollution management, damaging natural habitats, polluting groundwater resources, creating air and water pollution fall into this category. As these crimes pose a serious threat to the environment and human health, they may face serious penalties by the Turkish Penal Code.

Fraud-related crimes include fraudulent activities during construction projects and construction of structures. These offenses can include, for example, situations where customers deposit money and receive no return, business owners replacing materials with low-quality or incorrect materials. Such fraudulent acts can cause serious damage during construction projects and construction of structures.

TTK (Turkish Commercial Law) also includes many regulations related to construction law. The TCC regulates construction contracts and determines the rights and responsibilities of the parties. Once the contract is done, the contractor must complete the work and the customer must pay as per the contract. In these contracts, the rights and obligations of the parties, when the work will start, the date of completion of the project, payment terms, penalties to be applied in case of delay and other issues are specified.

In addition, the TCC includes regulations regarding the supply, purchase and transportation of materials and equipment in construction projects. The quality and cost of materials and supplies are of paramount importance to the success of construction projects. Therefore, TTK regulates the supply and correct operation of quality materials and equipment.

Construction law covers many topics during construction projects and construction of structures. Relevant laws such as the Turkish Penal Code and the TCC contain many regulations and provisions on these issues. Construction law is very important to the success of construction projects and therefore it is important that everyone working in the construction industry has a good grasp of these issues. Compliance with the provisions of the TCC and TCC is vital to the success of construction projects, and violations of construction law can have serious consequences.
